Terms and conditions

The German-language version of these terms (/de/agb) is legally binding. This English version is provided for convenience.

§ 1 Scope

These general terms and conditions apply to all orders placed via the online shop and to all bookings of workshops and events at bothintime.com between Both In Time, Jan Zajfert, Gutenbergstraße 96, 70197 Stuttgart (hereinafter "we") and you as a consumer, in the version current at the time of order. We do not recognise any deviating terms from you unless we have expressly agreed to them in writing.

§ 2 Contract formation

The display of products in the online shop is not a binding offer but an invitation to you to submit an offer (invitation to treat, invitatio ad offerendum).

By completing the order process via the "Buy now" button you submit a binding offer to enter into a purchase contract. We confirm receipt of your order without delay by email; this confirmation is not yet an acceptance. The purchase contract is concluded only when we explicitly accept the order or when we ship the goods.

§ 3 Prices and delivery costs

All prices are in euros and include statutory VAT (19%).

Delivery costs are shown separately before you complete the order. Standard within Germany: free. Switzerland: €16.90. Rest of Europe outside the EU: €19.90. United States: €23.90. Shipping is via DHL.

§ 4 Payment

We accept the payment methods displayed during the order process. Payments are processed by Mollie B.V. The purchase price is due upon contract formation.

§ 5 Delivery

We deliver within Germany and to the countries outside the European Union that are selectable during checkout. We do not currently deliver to other member states of the European Union. Every camera is a hand-made single piece and carries a stamped, sequential number. It is made after your order and is not held in stock, so a production time is added to the shipping time.

Because every camera is made by hand in small batches, it shows craft-related variation: in the shade of the carton, in the exact position of the stamped serial number, and in the smallest tolerances of the finish. These characteristics are part of the condition described on the product page (§ 434 (2) BGB). For deviations beyond that, and for functional defects, your statutory warranty rights apply in full.

We begin making your camera once your payment has reached us. Production takes five working days. Shipping from handover to the carrier, and the total delivery time, are:

Working days are Monday to Saturday, excluding nationwide German public holidays. For orders of six cameras or more we state the delivery date in the quote beforehand.

We ship climate-friendly via DHL GoGreen.

The times above include customs clearance.

For delivery to a country outside the VAT territory of the European Union we do not charge German VAT; the sale is a VAT-exempt export supply (§ 4 no. 1 lit. a in conjunction with § 6 UStG). The price shown is the final price you pay us.

On import into the destination country, additional charges arise — in particular customs duty and the import VAT applicable there. These charges are not included in the price, are levied by the authorities of the destination country, and are payable by you as the recipient (DAP delivery terms). The carrier may add a handling fee for this. We cannot pay these charges on your behalf and cannot predict their amount; it is set by the law of the destination country.

§ 6 Retention of title

The goods remain our property until full payment has been made (§ 449 BGB).

§ 7 Warranty

Statutory warranty rights apply. The limitation period for warranty claims is two years from delivery of the goods (§§ 437, 438 BGB).

§ 8 Right of withdrawal

When buying goods, consumers have a fourteen-day right of withdrawal. Details and the model withdrawal form are on the right-of-withdrawal page.

The statutory right of withdrawal under §§ 312g, 355 of the German Civil Code applies to consumers in the European Union. We voluntarily grant the same fourteen-day right on the same terms to consumers outside the European Union. You bear the direct cost of returning the goods in that case too, and returning them from a distant country may cost more than the goods are worth. We do not refund import charges you have already paid — you would need to reclaim those from the customs authority of your country.

There is no right of withdrawal for workshops and other events on a fixed date (§ 312g(2) no. 9 German Civil Code); the cancellation terms in § 9 apply instead.

§ 9 Workshops and events

The following provisions apply in addition to bookings for workshops and other events. Where they differ from the other provisions of these terms, they take precedence.

(1) Contract formation and payment. The participation fee is payable on booking. The contract comes into being when payment is received; only then is your seat firmly reserved. The price stated is a total price and includes statutory VAT.

(2) No right of withdrawal. Contracts for services connected with leisure activities for which a specific date is provided carry no right of withdrawal (§ 312g(2) no. 9 German Civil Code). Workshops take place on a fixed date, so the fourteen-day right of withdrawal under § 8 of these terms does not apply to them. Paragraph 3 applies in its place.

(3) Cancellation by you. You may cancel your booking free of charge up to 14 days before the event begins; we then refund the participation fee in full. After that, no refund is possible. Cancellation is informal, by email to hello@bothintime.com; the time it reaches us is what counts.

(4) Substitute participant. Up to the day before the event you may name a substitute to take your seat, at no charge. Send us the substitute's name and email address by email.

(5) Cancellation by us. If we cannot hold an event — for instance through illness, too few participants, or force majeure — we refund the participation fee in full. We will tell you without delay. Further claims, in particular for travel or accommodation costs, exist only as provided in § 10.

(6) Non-attendance. If you do not attend without cancelling, the participation fee remains payable.

(7) Materials and results. The work produced during the workshop and the camera handed to you become your property. We accept no liability for items you bring with you, except as provided in § 10.

§ 9a Gift vouchers

(1) What we sell. We sell two kinds of gift vouchers: the workshop voucher for one seat in a workshop under § 9, and the camera voucher for one Both In Time camera. Each voucher embodies exactly one named product (single-purpose voucher, § 3(14) of the German VAT Act). Partial redemption, residual credit and payout in cash are excluded.

(2) Delivery. The voucher is delivered digitally: after receipt of payment you receive the voucher code, a printable voucher card and the invoice by email. Nothing physical is shipped at purchase.

(3) Validity. The voucher is valid until the end of the third calendar year after the year of purchase. The validity date is stated in the voucher email. After expiry the voucher can no longer be redeemed.

(4) Redemption. The workshop voucher is redeemed when booking a workshop date and is good for one seat at any future date; § 9 applies to the booked seat accordingly. The camera voucher is redeemed on the redemption page at bothintime.com and requires a delivery address in Germany; shipping within Germany is included in the voucher. Each code can be redeemed exactly once.

(5) Transferability. The voucher is transferable. Whoever holds the code may redeem it, so keep the code safe. If a workshop seat paid with a voucher is cancelled in time under § 9(3), we reverse the redemption; the voucher is then valid again.

(6) Withdrawal. The right of withdrawal under § 8 applies to the purchase of a voucher; the period begins on the day the contract is concluded. A voucher that has already been redeemed can no longer be withdrawn.

(7) Discount codes. Discount codes issued by us (for example from collaborations) reduce the product value, not the shipping costs. One code can be redeemed per order. Discount codes are not vouchers within the meaning of this section and may be deactivated by us at any time with effect for the future.

§ 10 Liability

We are liable without limitation for intent and gross negligence and as provided by the Product Liability Act, and in cases of injury to life, body or health.

For slight negligence we are liable solely for breaches of essential contractual duties — duties whose performance makes the proper execution of the contract possible in the first place and on whose observance you may regularly rely. In such cases liability is limited to damage that was foreseeable at the time of contract formation and typical for the contract. Any further liability for slight negligence is excluded.

§ 11 Dispute resolution

The European Commission's Online Dispute Resolution platform ceased operation on 20 July 2025.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Applicable law and contract storage

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your habitual residence within the EU remain unaffected (Art. 6 Rome I Regulation).

We store the contract text of your order; you receive it by email after the order is placed.

§ 13 Contract language

The contract language is German. English and Spanish versions of these terms are provided for information; in case of conflict, the German version prevails.
